Awqaf Issues Guidance on Respecting the Privacy of the Deceased

Kuwait: Kuwait’s Ministry of Awqaf, through its Fatwa and Sharia Research Sector, has issued a new ruling regarding the deceased. The fatwa prohibits using fingerprints or facial recognition to unlock the phone of someone who has passed away.

This decision comes after a query from the Funeral Affairs Department Director who sought clarification on the permissibility of such actions. The Ministry’s fatwa emphasizes the importance of respecting the privacy of the deceased. Using biometrics to access their phone could potentially expose sensitive or private information.

The Ministry considers such actions to be a violation of the deceased’s dignity and sanctity. However, the fatwa acknowledges that there might be legitimate reasons to access a deceased’s phone. In such cases, the Ministry advises following proper legal channels. This could involve seeking authorization from the court or involving relevant security authorities, reported Al Qabas daily.
